Meeting Minutes of March 7, 2006


Public Hearings called to order at 7:31 PM by Chairman Latincsics.

Roll Call:

1.  File #2005-42 - Application for a Special Permit for Plumbing, Heating and Radiant Flooring Services at property at 479 Tolland Tpke. (Map 21, Lot 20-01) Owner: John Schneider; Applicant: Wayne Cyr (Received 12/6/05, Public Hearing 2/7/06 continued to 2/21/06, continued to 3/7/06, Decision by 5/2/06)

Mr. Tulis recused himself from this Public Hearing.

Mr. Cyr was present and submitted the approval letter from Eastern Highlands Health District for use of the office and storage space.  

M. Ellis made a motion to close the Public Hearing on File #2005-42, seconded by P. Nevers, Unanimously approved.


2.  File #2005-43 – Application for a Special Permit for a consulting soil scientist at property at 479 Tolland Tpke. (Map 21, Lot 20-01) Owner: John Schneider; Applicant: Richard Zulick (Received 12/6/05, Public Hearing 2/7/06 continued to 2/21/06, continued to 3/7/06, Decision by 5/2/06)

Mr. Tulis recused himself from this Public Hearing.

Mr. Zulick was present and submitted the approval letter from Eastern Highlands Health District for use of the office space.

M. Ellis made a motion to close the Public Hearing on File #2005-42, seconded by P. Nevers, Unanimously approved.


3.  File #2006-02 – Application for a 14-Lot Subdivision on property on Mihaliak Rd. (Map 50, Lot 3) Owner/Applicant:  Mary C. Litwinczyk & Litwinczyk Children, LLC.  (Received 1/17/06; Public Hearing 3/7/06, Decision by 3/7/06)

R. Tulis was seated for this Public Hearing.  R. Tulis noted that the legal notice indicated that this was a subdivision when in fact it was for a resubdivision.  The Commission decided that this application should be republished as a resubdivision and a Public Hearing will be held on 3/21/06.  
 
4.    File #2006-06 – Application for a Special Permit for Day Care at 330 River Road (Map 30, Lot 31-A, Zone DNC) Owner/Applicant: Daniel R. Cote. (Received 1/17/06, Public Hearing 2/21/06, to 3/7/06, Decision by 5/2/06)

Applicants Surveyor or Engineer was present and submitted revised plans to address comments from K. Acimovic, Town Engineer.  

A. Marco asked if the applicant felt that they had meet the requirement for drop off area as required by the regulations.  The applicant discussed some of the options they had looked at for a drop off area and it was too costly.  The applicant feels that they have met the requirement for a drop off zone.  

Questions were asked by members concerning future expansion, play ground area, and sidewalks.  

Agent Jones was concerned with the width of the buffer, drainage design, drop off area and building foot print.

The new plans and drainage calculations will be forwarded to the Town Engineer for further review.

M. Ellis made a motion to continue the Public Hearing to 3/21/06, seconded by A Marco, unanimously approved

A.  Regular Meeting:

Regular Meeting was called to order by Chairman Latincsics.

C.  New Business

1.  Review and renewal consideration of the Wilderness Lake Campground special permit located at 150 Village Hill Road.  (Map 43, Lot 124) Owner: KMC, LLC. Site Walk 3/18/06 at 9 am.

Site walk scheduled for 3/18/06.  Application was tabled.

2.  File #2006-11 – Application for a Special Permit to operate an adult retail store on property at 15 River Rd (Map 5, Lot 3, Zone DC) Owner: Amy Moore; Applicant: Christopher Ferrone. (Received 2/7/06; Public Hearing on 4/4/06; Decision by 6/6/06)

Public Hearing scheduled for 4/4/06.

D.  Pre Application

1.  Steve Amedy to discuss proposed senior housing on River Road and Baxter Road.

Mr. Amedy passed out plans showing a proposed elderly housing project located off of River Road.  It will consist of 60 homes with its own community septic and water system.
Project also includes four (4) separate lots for single family homes off River Road.

Mr. Amedy was concerned that he would have to construct the community water system prior to applying for his special permit.  R. Tulis and members discussed this section and informed Mr. Amedy that he would need his certificate from the state before applying.

Procedures were discussed concerning the timing of the different applications

E.  Old Business

1.    File #2006-12 – Application for Modification of Special Permit to modify floor plan at 479 Tolland Tpke. (Map 21, Lot 20-1, Zone DC) Owner/Applicant:  John Schneider (Received 2/21/06, Decision by 4/18/06)

This application was tabled as it has not received Health Department approval.

Members discussed submitted information and had been waiting for Health District approval which was submitted tonight.

M. Ellis made a motion to approve File #2005-42, seconded by Nevers, unanimously approved.

4.    File #2006-10 – Application for Modification of Special Permit to replace the fuel island and install fuel island w/canopy at FedEx 350 Ruby Road (Map 42, Lot 48-1, Zone DI) Owner: FedEx; Applicant: Diamond Z Engineering, Inc. (Received 2/7/06; Decision by 4/4/06)

R. Tulis recused himself from this application and left the table.

Representatives from FedEx and the Contractor were present for this application.

The commission was shown the plans and the extent of the new layout for the fueling island including a canopy, new fueling stations and new doubled wall piping.  The members were concerned about the catch basin with the Hydroclean system.  This system was approved by the DEP and members were satisfied.  

The applicants indicated that they requested a letter from DEP stating the approval but have hot received it as of this meeting.

M. Ellis made a motion to approve File #2006-10 with the following conditions:  1. The DEP approval letter be submitted.  2.  Maintenance manual shall be updated to include revisions and the Hydroclean Filter.

Seconded by P. Nevers, Unanimously approved.









5.    File #2006-06 – Application for a Special Permit for Day Care at 330 River Road (Map 30, Lot31-A, Zone DNC) Owner/Applicant: Daniel R. Cote. (Received 1/17/06, Public Hearing 2/21/06, Decision by 4/18/06)


Tabled as the Public Hearing was continued to 3/21/06.

7. File #2005-36 – Application for 14 Lot Subdivision on property at 22 Kucko Rd. (Map 42, Lot 8-1) Owner: Raymond Crossen; Applicant: R. F. Crossen Contr. (Received 11/15/05; Public Hearing 1/17/06 continued to 2/7/06 continued to 2/21/06; Decision by 4/18/06)

Members discussed the information submitted by the Conservation Commission as well as information submitted during the public hearing by the applicant.

This discussed involved open space, road improvements, reconstruction of new proposed road over existing driveway, drainage, wildlife corridors and open space and completeness of the submittals.  

Commission members were to review information and make lists to be discussed at the next meeting.

F.  Public Comment

Members of the Conservation Commission asked about the landscaping and plans and wanted to make sure that there were not any invasive species included in the planting lists.  Agent Jones informed them that this is reviewed by staff as well as other.

G.  Minutes

N. Gray made a motion to approve the minutes of 2/21/06 as amended, seconded by A. Marco, unanimously approved.


H.  Correspondence

Members reviewed the following correspondence:  

1. Spill report from DEP for 140 River Road.

2.  Letter from the Conservation Commission to the Board of Selectmen.  RE:  Roaring Brook Loop Trail.

3.  Letter from D. Lytwyn to the Town Clerk resigning from the Planning and Zoning Commission dated Feb. 7, 2006.

4.  Letter from the Board of Selectmen to the Planning and Zoning Commission announcing the appointment of R. Tulis to fill the spot vacated by D. Lytwyn


I.  Staff Report and Discussion

Chairman Latincsics discussed the Special Meeting held on Saturday March 4, 2006.
